This agreement is entered into between the CLIENT and the PHOTOGRAPHER (Manon Hak).
1. Deposit and Payment:
Upon signing this agreement, the PHOTOGRAPHER will reserve the agreed-upon time and date exclusively for the CLIENT and will not accept other bookings for that slot. The CLIENT is required to pay a non-refundable deposit of 25% of the total invoice amount to the PHOTOGRAPHER upon signing.
The remaining balance must be paid no later than four weeks after the wedding date. No services will be provided until full payment is received. All photos will be delivered only after payment is completed.
2. Deliverables:
All photos will be provided in digital format. High-resolution JPEG images will be made available for download via an online gallery within two months of the event date. RAW files will not be provided.
The online gallery will remain accessible for four months from the delivery date. CLIENT may download images from the gallery solely for personal use. Images may not be edited, altered, or reproduced in any form without the PHOTOGRAPHER's explicit written permission.
3. Rescheduling:
If the CLIENT needs to reschedule the session due to illness, emergencies, or unforeseen circumstances beyond their control, the deposit will be applied to the new session date.
4. Cancellation:
If the CLIENT cancels this agreement within 24 hours of the scheduled photoshoot or fails to show up, all payments made to the PHOTOGRAPHER will be retained.
5. Liability:
5.1 The PHOTOGRAPHER is not responsible for missed moments, specific poses, or specific individuals during the session.
5.2 The PHOTOGRAPHER is not liable for compromised coverage due to external factors, including but not limited to late arrivals, weather, location restrictions, or guest interference.
5.3 If the PHOTOGRAPHER cannot perform due to illness, emergencies, or circumstances beyond their control, reasonable efforts will be made to find a replacement photographer. If no replacement can be found, all payments made by the CLIENT will be refunded.
5.4 The PHOTOGRAPHER is not liable for technological malfunctions or loss of photographic materials unless due to their negligence. In such cases, liability is limited to a refund of payments made.
5.5 The CLIENT has 14 days from the gallery delivery date to report any issues or discrepancies. After this period, the PHOTOGRAPHER is not obligated to address complaints.
5.6 The PHOTOGRAPHER reserves the right to leave a session if faced with inappropriate, threatening, or unsafe behavior. No refunds will be issued in such cases, but images taken prior to leaving will be provided.
6. Permissions and Permits:
The CLIENT is responsible for obtaining all necessary permissions and permits for the photoshoot. The PHOTOGRAPHER will not be held liable for any fines or issues resulting from a lack of permissions.
7. Exclusive Photographer:
The CLIENT agrees that no other photographers or individuals may interfere with or replicate the PHOTOGRAPHER's setups during the session. This ensures the quality and integrity of the PHOTOGRAPHER's work.
8. Copyright and Model Release:
8.1 The PHOTOGRAPHER retains copyright of all images and reserves the right to use them for portfolio, marketing, or promotional purposes.
8.2 If images include minors, the CLIENT grants permission for their use as outlined above.
8.3 Commercial use of images for purposes outside the PHOTOGRAPHER's business requires prior written consent from the CLIENT.
9. Social Media and Personal Use License:
The CLIENT is granted a perpetual, non-exclusive license to print and share provided images under the following conditions:
9.1 CLIENT may share images on personal and business social media accounts with proper credit and tagging of the PHOTOGRAPHER.
9.2 Images may not be altered, edited, or screenshotted in poor quality.
9.3 Prints made from the images are for personal use only and cannot be sold, licensed, or submitted to contests.
10. Pricing and Additional Products:
Services or products not included in this agreement will be subject to current pricing at the time of the order.
